CHANGES TO LEGISLATION


Changes to the Management of Health and Safety at Work Regulations 1999 (L21 ACOP)

During the review of the Health and Safety law and Regulations in 2013, the Management of Health and Safety at Work Regulations 1999 (ACOP L21) was removed.
There is now instead, guidance for employers referred to as - HSG65.

In respect of delivering EFAW, FAW, Paediatric and Anaphylaxis courses, rather than refer to the old 1999 Regulations, it should now be referred to as HSG65 guidance.
If employers are looking for information on how to manage risks in their business, the HSE has a suite of guidance that will be able to help. The guidance is divided into four sections:

ID ON COURSE REGISTERS


You will start to see over the next few weeks, the introduction of a new column on the Course Registers that you receive from ourselves called ‘Learner Identity verified’. This is to satisfy an OFQUAL requirement:

Condition G5 Registration of Learners

G5.1 An awarding organisation must take all reasonable steps to ensure that –

(a) each Learner taking a qualification which the awarding organisation makes available is registered in a way that permits the Learner to be clearly and uniquely identified, and
(b) where the identity of a Learner has not previously been confirmed to the awarding organisation, or the Centre at which the assessment will take place, arrangements are in place to confirm the Learner’s identity.

This means that for any course that you run that is accredited by OFQUAL, you will need to check the identity of the learners. If you are doing a course for one organisation then a declaration from the Management/Supervisor is acceptable and you can initial this column as checked. For an open course, you will need to confirm the identity of the learner. This can be in the form of a passport/driving licence/bank card/work id/etc, so please ensure that you request that they bring this with them on any joining instructions that you issue to the Learners.
