Terms and Conditions for use of nucoplus® Course Management System, 'Course Finder' and Instructor/Assessor database.
If you wish to use the Course Management facilities, you must read and accept the following terms and conditions.
1.0 Definitions
1.1 Nuco in the following terms and conditions refers to Nuco Training Ltd.
1.2 CMS refers to the on-line Course Management System provided for:
- Notifying and amending courses.
- Advertising courses on "Course Finder".
- Notifying results of courses and ordering certificates.
- Accessing the course results database.
1.3 Approved User is a Nuco-registered Instructor, Assessor or customer who has been issued approval and user facilities by Nuco Training Ltd.
1.4 Instructor is a Nuco-registered Instructor who has been issued approval and user facilities by Nuco Training Ltd.
1.5 Paperwork is the set of papers relevant to the course and provided by Nuco Training Ltd including, for example, Course Register, Certificate Order Form, Evaluation Forms, Recap Paper, Assessment Papers etc.
2.0 General Rules
2.1 The CMS may only be used by Approved Users or person(s) specifically designated by an Approved User to enter data on his/her behalf. Approved Users must protect their password at all times.
2.2 Approved Users will be responsible for the appropriate use of the CMS facilities and accuracy of data they enter.
2.3 The CMS has been established to assist Nuco Instructors and customers to promote and administer their first aid training courses. The data provided and held must be used solely for these purposes and not used, or disclosed to other bodies, for any other purpose.
2.4 The CMS is for the use of Instructors who require Nuco to administer their courses and provide certification. The CMS is not for the use of Instructors who issue their own certificates. Instructors who plan to issue their own certification for a particular course do not need to notify such courses to Nuco and these courses will not be shown on 'Course Finder'.
3.0 Notifying courses
3.1 Courses should be notified with 28 days notice where possible, particularly when an Instructor, Monitor or an Assessor is required. For First Aid at Work and FAW Refresher courses in Northern Ireland, 28 days' notice strictly applies, so, if you require because a Monitor or Assessor, you must allow additional time.
3.2 If you require assistance in locating a Nuco Instructor or Assessor to assist with your training, you may use the nucoplus® search facility to identify Instructors or Assessors by location. You will be responsible for contacting the Instructors or Assessors, agreeing assignment terms, payment and cancellation.
3.3 Access to the Instructor/Assessor database is solely for your personal use and for locating an Instructor/Assessor to assist you in first aid training that is administered and certificated by Nuco. The information must not be used for any other purpose without the prior written consent of Nuco. In no circumstances should the data be transferred to a third party. In using this facility, you must respect the wishes and confidentiality of the persons listed on the database.
3.4 If, when notifying a course, you indicate that you need Nuco to appoint an Instructor, Monitor or Assessor(s) for your course, you will be charged at the time of notifying the course or, if you are an account holder, you may choose to be invoiced when your certificates are ordered. Nuco will pay the Instructor, Monitor or Assessor(s). If you cancel a course within 7 working days of the course commencement, you will be charged a compensatory fee of £25.00 per each Instructor, Monitor or Assessor assigned through Nuco plus £25.00 administration fee. The compensatory fees will be paid to the Instructor, Monitor or Assessors(s) concerned.
3.5 If you request course paperwork on-line, the pack will be posted to the address you nominate. Alternatively, you can download copies of the forms from the nucoplus® website or copy the forms provided in your Tutor Pack. These forms must not be altered in any way, or alternatives used, without the prior agreement of Nuco.
4.0 Advertising Courses on 'Course Finder'
4.1 All courses notified to Nuco will be included on the 'Course Finder' page. However, if your course is full, or not open to additional students, it will be listed but shown as 'course full' with no contact details.
4.2 If you advertise your course on 'Course Finder', it will be your responsibility to maintain course details in an up-to-date and accurate state. Courses listed will be deleted once the course date has expired.
4.3 Instructors are required to respond to all 'Course Finder' enquiries they receive in a prompt and business-like manner - remembering that all such callers are potential customers and that a poor response will reflect badly on Nuco and Nuco-registered Instructors generally.
4.4 Instructors should not advertise courses on 'Course Finder' unless there is a reasonable prospect of the course taking place.
4.5 Nuco reserves the right to exclude courses from the Course Finder page without having to provide reasons for such exclusion.
5.0 Course delivery.
5.1 It is the responsibility of the Instructor to ensure that every course he/she delivers complies with all current programmes and protocols established by Nuco Training Ltd and the Health and Safety Executive.
6.0 Notifying Course Results and Ordering Certificates on-line.
6.1 Responsibility for the accuracy and integrity of course results shall rest with the Instructor who ran the course in question. The results must be based on the Instructor conducting the course and assessments being conducted strictly in line with Nuco's guidelines and procedures.
6.2 Certificates must not be ordered in advance of the course completion unless there are exceptional circumstances (e.g. delegates being posted overseas following the course). In such circumstances, names of delegates must be provided and the Instructor must ensure that certificates are only issued on successful completion of the course. You will be charged for all certificates provided.
6.3 For the purposes of quality assurance, Instructors must allow students to freely complete course evaluation forms in respect of all courses. Instructors must examine remarks on such evaluation reports and adopt measures to ensure that any reported weaknesses are remedied. General unsatisfactory remarks from delegates must be reported to Nuco with the Instructor's comments immediately following the course in question.
7.0 Retention of course paperwork and Quality Control
7.1 One of the benefits of notifying courses and results on-line is the reduction of paper transfers and related costs, for example, in posting completed course paperwork to Nuco. However, the completion of Nuco paperwork is a compulsory part of correct course delivery and the completion and examination of course evaluation forms is important for ensuring that courses meet the quality standards expected by Nuco and the Health and Safety Executive. To maintain these standards, Instructors who notify courses and results on line, will be required retain the paperwork (in hard copy or scanned format) for a minimum period of 5 years.
7.2 Nuco reserves the right, at any time, to inspect retained paperwork for any completed course (as selected by Nuco) for quality assurance purposes. Therefore, Instructors must forward to Nuco any paperwork so requested by Nuco.
7.3 Nuco also reserves the right to appoint a Monitor to attend any course for the purposes of monitoring standards of training delivery. Such visits will be with the prior agreement of the Instructor concerned. The Instructor will be expected not to unreasonably withhold such agreement. The Instructor will be given a copy of the Monitor's report.
8.0 Certificates.
8.1 Instructors may request up to 2 logos to be printed on their certificates. Nuco reserves the right not to include logos that may be considered inappropriate or below quality standard for printing or do not comply with HSE standards and expectations. Unfortunately, we are unable to include such logos on certificates for Northern Ireland.
8.2 Approved users may request the inclusion of additional wording on certificates, other than First Aid at Work certificates, but such wording must be approved in advance by Nuco.
9.0 Access to course results data base
9.1 Instructors will be allowed to access data relating to their own courses on a 'read-only' basis.
10.0 Certificate fees and payments
10.1 The cost of providing the Course Management System and course paperwork by Nuco will be covered in the price of certificates. The price of certificates will be as determined by Nuco.
10.2 The cost of Monitor, Assessors and/or first aid books or equipment requested at the time of notifying the course on-line must be paid for by credit or debit card at the time of notifying the course. However, if you have an account with Nuco, you can pay via invoicing.
11.0 General Copyright and Confidentiality
11.1 Instructors are required to protect the copyright and confidentiality of all matters and materials made available to them but not to the general public such as Tutor notes, course paperwork, downloadable material, information relating to the Nuco business and persons associated with Nuco.
12.0 Breach of these Terms and Conditions
12.1 Minor breaches of the above terms and conditions such as, loss of retained paperwork, an administrative error or genuine mistake or misunderstanding may result in a written warning. A further minor breach may result in the withdrawal of the on-line facility. Continual minor breaches may be treated as a serious breach as below.
12.2 A serious breach of the above terms and conditions such as critical failure to deliver a course in line with Nuco's protocols, falsification of course paperwork or results, breach of copyright, failure to pay Nuco or Assessors, continual disregard to warnings as in paragraph 12.1 above will result in the Instructor being delisted as a Nuco Instructor/Assessor. It may also lead to invalidation of course results, appropriate legal action and/or a possible report to the Health & Safety Executive.
12.3 Breaches of terms and conditions will be for Nuco to determine. The above examples are not exclusive or exhaustive.
